TERMS OF SERVICE

These Terms of Service govern your use of the professional photography services provided by Capture IT Studios, headquartered in Raleigh, North Carolina. By booking a session, submitting a deposit, or engaging Capture IT Studios to perform any of our photography services — including commercial photographyreal estate photographyaerial photography, drone photography and sport photography — you agree to be bound by these Terms in their entirety.

1. Agreement to Terms

These Terms of Service (\”Terms\”) constitute a legally binding agreement between you (\”Client,\” \”you,\” or \”your\”) and Capture IT Studios (\”Company,\” \”we,\” \”us,\” or \”our\”), a professional photography services provider headquartered in Raleigh, North Carolina. By requesting a quote, booking a session, making a payment, or otherwise engaging Capture IT Studios to perform any of our professional photography services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, please do not use our services.

2. Services Overview

Capture IT Studios provides professional photography services across Raleigh, the Triangle, and throughout North Carolina including, but not limited to: commercial photography; real estate photographyaerial photography; drone photography and sport photography. All aerial and drone photography operations are conducted in full compliance with FAA Part 107 regulations by certified remote pilots. The specific scope, deliverables, timeline, and pricing for each engagement are outlined in the individual project proposal or service agreement provided to the Client prior to commencement of work.

3. Booking and Payment

Proposals and Acceptance: All engagements begin with a written project proposal that details the scope of work, deliverables, pricing, and estimated timeline. The engagement is considered confirmed once the Client accepts the proposal in writing (including email) and submits any required deposit payment.

Pricing: Service pricing is quoted on a per-project or per-session basis and is valid for 30 days from the date of the proposal unless otherwise stated. Prices are in U.S. dollars and do not include applicable sales tax unless explicitly noted.

Payment Terms: A non-refundable retainer of 50% of the total project cost is required to confirm your booking and reserve your date. The remaining balance is due upon delivery of final deliverables unless alternative payment terms are agreed upon in writing.

Late Payment: Invoices not paid within 15 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. Capture IT Studios reserves the right to withhold deliverables until all outstanding balances are paid in full.

4. Cancellation and Rescheduling

Client Cancellation: If the Client cancels a confirmed booking more than 72 hours before the scheduled session or event date, the deposit will be applied as a credit toward a future booking valid for 12 months. Cancellations made within 72 hours of the scheduled session are non-refundable, as photographer scheduling and preparation resources have already been allocated.

Cancellations made more than 30 days in advance will receive a 50% credit toward a future booking.

Rescheduling: Clients may reschedule a confirmed booking at no additional charge with at least 48 hours’ notice, subject to photographer and date availability.

Weather Delays: Outdoor photography sessions — including, sport photography, and aerial/drone operations — are weather-dependent. If a scheduled session cannot be conducted due to adverse weather conditions (rain, storms, high winds, or unsafe conditions), Capture IT Studios will reschedule the session at no additional cost at the earliest mutually available date. Weather-related rescheduling is not considered a cancellation.

5. Drone and Aerial Photography Compliance

All aerial and drone photography operations conducted by Capture IT Studios are performed in full compliance with Federal Aviation Administration (FAA) regulations under 14 CFR Part 107. Our pilots hold valid FAA Part 107 Remote Pilot Certificates and follow standardized safety protocols for every flight across Raleigh, the Triangle, and throughout North Carolina. Capture IT Studios is responsible for obtaining any required FAA airspace authorizations (LAANC or manual waivers) for flights in controlled airspace near Raleigh-Durham International Airport and other NC airports. The Client is responsible for ensuring that we have legal access to the property or site where aerial services will be performed. If a flight cannot be safely or legally conducted due to airspace restrictions, temporary flight restrictions (TFRs), or site access issues outside our control, we will work with the Client to reschedule or modify the mission plan accordingly.

6. Deliverables and Intellectual Property

Ownership: Upon receipt of full payment, the Client receives a non-exclusive, perpetual license to use all delivered photographs, edited images, aerial footage, and other project deliverables for the purposes outlined in the project proposal. Capture IT Studios retains the underlying copyright to all creative works produced unless a full copyright transfer is agreed upon in writing and reflected in the project pricing.

Portfolio Use: Capture IT Studios reserves the right to use anonymized or non-confidential samples of delivered work in our portfolio, website, social media, and marketing materials unless the Client explicitly requests confidentiality in writing prior to commencement of the project.

Delivery Timeline: Standard delivery timelines are 24–48 hours for real estate photography, 3–5 business days for commercial and sport photography sessions, and 48 hours–5 business days for aerial and drone photography projects depending on scope. Rush delivery is available for an additional fee. Delivery timelines begin after the session or event is completed.

Data Retention: Completed deliverables and raw project files are retained on our secure servers for 90 days following final delivery. After this period, data may be archived or permanently deleted. Clients who require extended retention should request this in writing before or at the time of booking.

7. Image Editing and Revisions

Standard Editing: All photography packages include professional color correction, exposure adjustment, and retouching as outlined in the project proposal. The number of fully edited images varies by package and will be specified in the booking agreement.

Revisions: Each package includes one round of revision requests, which must be submitted within 14 days of gallery delivery. Additional revision rounds may be accommodated at an hourly rate agreed upon in advance. Capture IT Studios reserves final creative discretion over editing style and processing techniques consistent with our portfolio and brand aesthetic.

Image Alteration: The Client agrees not to alter, distort, or apply additional filters to delivered images in a manner that misrepresents the work of Capture IT Studios when crediting or tagging the Company in any public-facing media.

8. Client Responsibilities

The Client agrees to provide accurate and complete information about the project site, venue, property, event, or subject of the photography services; ensure that Capture IT Studios has authorized legal access to the location or venue where services will be performed; inform Capture IT Studios of any known hazards, restrictions, or special conditions at the project location; obtain any necessary permissions from property owners, venue managers, event coordinators, or relevant third parties prior to the scheduled session; provide a detailed shot list or list of priority groupings for event photography at least 7 days prior to the event; and communicate any specific confidentiality, safety, or operational requirements in advance of the engagement.

9. Insurance and Liability

Insurance: Capture IT Studios maintains comprehensive general liability insurance with minimum coverage of $1,000,000 per occurrence. Certificates of insurance (COI) are available upon request for any project or venue requirement.

Limitation of Liability: To the maximum extent permitted by law, Capture IT Studios’ total liability for any claim arising from or related to our services shall not exceed the total amount paid by the Client for the specific project giving rise to the claim. Capture IT Studios shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost revenue, or business interruption, regardless of the cause of action.

Equipment Failure: While Capture IT Studios uses professional-grade equipment and carries backup gear to every session, in the rare event of a complete equipment failure that prevents delivery of any usable images, our liability is limited to a full refund of the amount paid for that specific session.

Force Majeure: Capture IT Studios shall not be held liable for delays or failure to perform services due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, FAA-imposed flight restrictions (for aerial services), government actions, venue closures, pandemics, or other force majeure events.

10. Indemnification

The Client agrees to indemnify and hold harmless Capture IT Studios, its owner, employees, photographers, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from the Client’s breach of these Terms, the Client’s misuse of delivered content or images, the Client’s failure to obtain required venue or site access or permissions, or any inaccurate or misleading information provided by the Client in connection with the engagement.

11. Confidentiality

Capture IT Studios treats all client project details, property information, personal photographs, and business information as confidential. We will not disclose confidential client information to third parties without the Client’s written consent, except as required by law or as necessary to fulfill the contracted services (for example, sharing deliverables with the Client’s designated team members or stakeholders as instructed).

12. Dispute Resolution

Any disputes arising from or related to these Terms or the services provided by Capture IT Studios shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached through negotiation within 30 days, the dispute shall be resolved through binding arbitration administered in Wake County, North Carolina, in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney fees and costs.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal proceedings shall be conducted in the state or federal courts located in Wake County, North Carolina.

14. Modifications to Terms

Capture IT Studios reserves the right to update or modify these Terms of Service at any time. When changes are made, we will update the \”Last Updated\” date at the top of this page. Changes will apply to all new engagements booked after the effective date of the updated Terms. Existing confirmed bookings will be governed by the Terms in effect at the time of booking confirmation.
